SERVICE AGREEMENT

 

In the following terms & conditions “videographer” shall mean Mark Asplin trading as WHITE IN MOTION “The Client(s)” shall be those persons defined as couple in the wedding booking. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

1.Booking Fee

A booking fee of £250 secures the time and services of the videographer for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the videographer due to cancellation. The booking fee will be deducted from the cost of the clients chosen package when calculating the final payment due. Payment in full of the remaining balance will be due 4 weeks before the wedding day. Weddings that are postponed to a later date will retain the fee as long as the videographer can re-schedule for the new date and time. As standard business practice the clients have a 14 day cooling of period which starts from the date of the booking fee paid and the confirmation of booking by Mark Asplin.

2.Wedding Arrangements

The details of the wedding arrangements are to be agreed 2 weeks beforehand in writing via a schedule form supplied by the Videographer. The Clients shall notify the Videographer of any changes to these details in writing. The Videographers typical day consists from Bridal Prep to First Dance unless stated in writing otherwise.

3.Cancellation

The Clients may cancel this contract at any time by giving written notice to the Videographer but in doing so shall forfeit any monies paid. Cancellation less than 6 weeks before the wedding will result in the payment in full becoming due. All cancellations must be in writing.

5.Force Majeure or Act of God

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the Videographer will not be responsible for footage that is not produced due to technical failure.

6.Attendance

In the unlikely event of the assigned Videographer being unable to attend your wedding due to unforeseen circumstance, we reserve the right to appoint another videographer to attend your wedding on our behalf to undertake the wedding videography to his/her best ability and to a similar standard as the original videographer.

7.Limitation of Liability

In the unlikely event of total video/equipment failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

8.Delivery of Final Video

The delivery of the final video shall be by digital online link unless specified otherwise by the Client(s), said videos shall be delivered approximately 10 weeks from the date of the wedding (this can be longer in busy periods and you will be kept updated of your estimated delivery date).

9.Filming on Location

When filming a wedding in an uncontrolled environment the Videographer is sometimes limited by venue restrictions or the layout of the venue, it is understood by the Client(s) that the videographer will work to the best of his ability in each location and judge the best shot for each set of circumstances. Although the videographer will always endeavour to include all shots asked for by the client, the client understands that due to it being a live event that no shot is guaranteed.

10.Editing

By agreeing for Mark Asplin to film your wedding, you are allowing creative licence in shot composition, direction and editing of all the final films and understand that the final films are the videographers interpretation and vision of the day. It is also understood that you the client(s) have looked through my previous work and understand my filming and editing style of the final films. Editing a wedding video is an extremely time-consuming exercise, a typical wedding video can take over 30 hours to edit. All editing is done alone by Mark Asplin. Even minor alterations can be very time consuming, unless there is an obvious mistake, an hourly charge of £30 will be made for any extensive alterations.
